County, Breckenridge OK tax agreement due

October 21 — Cumberland County Commissioners approved an overdue tax property deal with the Breckenridge Lake Community Association, ensuring the county does not pay dues for property acquired through an overdue tax sale.

“We’re still working on a few more deals that we hope to bring to you soon enough,” Cumberland County Mayor Allen Foster told the committee on Monday.

The agreement notes that the county paid no assessment to the organization when it acquired property through an overdue tax sale. The deal formalizes this practice, similar to a deal approved with the Fairfield Glade Community Club in April.

The county has several thousand pieces of property throughout the county, many in planned communities like Breckenridge that assess membership fees to help maintain equipment. These lots become the property of the county after the owners have failed to pay property taxes for a number of years and are offered for auction by the clerk and master’s office. State law requires the county to bid first for these overdue tax lots, often resulting in these properties being owned by the county.

These lots do not generate tax revenue for the county.

The agreement states that Breckenridge will not assess the county for such dues or assessments and, in return, the county will not assume any rights or membership, such as use of amenities or voting in community association elections.

There have been discussions about changes in state law that would ensure that government agencies like Cumberland County cannot face monetary fees, although community associations can still place a lien on the property. for unpaid dues or appraisals and take possession of the property through this process.

The county lists property for sale through the county mayor’s office, with a listing available online at cumberlandcountytn.gov.

Nancy Hyder, 2nd District Commissioner, moved to approve the resolution, seconded by David Gibson, 4th District Commissioner. It was approved unanimously.

Prior to the committee meeting, the Overdue Tax Committee accepted an offer of $ 1,203.74 for a property in Druid Hills. The auction represented the total amount of back taxes owed on the lot plus legal fees. Since the offer settled the overdue tax payment, no county commission action was required.

In other matters, the commission also approved a budget resolution of $ 82,500 to go ahead with the paving of the new election commission office and in Obed River Park.

The item was not on the published agenda, but timing is critical, said Hyder, who offered to add the resolution to the agenda. The motion was seconded by Sue York, 1st District Commissioner, and unanimously approved. Board rules require a two-thirds majority to add an item to the meeting agenda.

“We consider this to be a health and safety issue,” said Hyder, who brought the issue to the committee following a building and grounds committee working session this week. last. The committee did not have a quorum and could not vote on items, but discussed several things that will come back to the committee at its meeting on October 25 at 4 p.m. at the Cumberland County Courthouse, 2 N Main St.

The Election Commission, 83 Northside Dr., needs the existing parking lot to be repaved and scratched before the early voting period for the May 2020 county primary election, with early voting scheduled to begin in April 2022.

Paving companies generally close their doors in the winter. This could make it difficult to complete the project before early voting, unless the county moves quickly, Hyder said.

County maintenance supervisor Adam Sebia said the county had received a favorable estimate for the work, noting that paving the ambulance service facility a few years ago cost around $ 96,000.

He proposed paving to the election commission to provide additional paving at the rear of the facility, thereby increasing parking availability. This would be a resurfacing project, which would save the county money compared to installing a new parking lot.

“We’re going to take what’s there and reuse it,” he said. “We’re also going to move the fence back. There’s a little more space, bay gate access and additional parking.”

He also recommended paving an existing gravel plot at the opposite end of the building housing the electoral commission. This land has never been paved, so it will require more work. This lot serves the office of the road department and the county maintenance department.

Due to the competitive quote, Sebia also recommended paving at the Obed River Park trailhead. The current gravel terrain is uneven.

“As you walk over there it’s a pretty good danger,” he said.

Foster noted that the project would also bring the trail into compliance with the Americans with Disabilities Act and help the county obtain state grants to improve the park.

Hyder moved to endorse the resolution, supported by York, and unanimously approved by the committee.

The county will solicit official bids for the project. Funding comes from the county’s unallocated fund balance.

District 8 Commissioner Jim Blalock did not attend the meeting.
